Son Makes Claim After Violent Past

Mrs Bertilla Girotto died in 2022 at the age of 90. Her estate was valued at $3.6 million. 11 days before her death, Bertilla changed her will. Her youngest son, Dante, was named as the executor of the estate. Dante was left most of the estate. Her oldest son, Maurisio, was left $300,000.

Maurisio made a claim against the estate. He believed Dante misled Bertilla to change the will. Maurisio argued that he deserved half of the estate. He claimed he needed it to pay his debts, alongside his business, mortgage and medical expenses.

Dante opposed the claim. Dante relied on Bertilla's notes explaining why she changed the will. She praised Dante for taking care of her. Maurisio was described as violent, ungrateful and driven by hate. The notes revealed that the $300,000 for Maurisio was to prevent him from making a claim.

The brothers had a violent history. In 2011, Maurisio attacked Dante in front of Bertilla. Dante later suffered a life-threatening aneurysm. Dante and Bertilla linked this to the attack. In 2021, Maurisio angrily arrived at the family home demanding to see Dante. The police were called. Maurisio was charged with intimidation and issued a restraining order.

The court accepted Dante's evidence of Bertilla's intentions. The court found that Bertilla’s decision was reasonable in the circumstances. The amount left for Maurisio was enough for his needs. The court upheld Bertilla’s wishes and Maurisio’s claim was rejected.
